Exchange of experience between prosecutors from Bihać and Tuzla

The working-consultative meeting held in Tuzla (18 February 2019) between prosecutors of the Cantonal Prosecutor's Office of the Tuzla Canton (KT TK) and the Cantonal Prosecutor's Office of the Una-Sana Canton (KT USK), the partner prosecutors of the USAID Judicial Project, was a unique opportunity for prosecutors from these two PO's to exchange experiences and good practices in the field of prosecution of complex forms of crime. The special focus in the discussion was on confiscating the property acquired through such crimes. The aim of the meeting was to facilitate direct discussion among prosecutors about good practices in the processing of corruption, organized and economic crime. The meeting was moderated by the Chief Prosecutor of the KT TK Tomislav Ljubić and the Chief Prosecutor of KT USK Fadila Amidžić, while the guest speaker at the meeting was the Head of the Office for seizure of property acquired through criminal offense of the Office for Combating Corruption and Organized Crime (USKOK) from the Republic of Croatia, Ms. Marija Vučko. Ms. Vučko, for the purpose of the meeting, was hired as an international expert by the Project "Strengthening public integrity in the Federation of Bosnia and Herzegovina and the Republic of Srpska".

During this meeting, the prosecutors discussed the factual design of indictments in the organized perpetration of the offense against official duty, the strategy of prosecutorial presentation before the court, and the representation of indictments and motions for confiscation of property acquired through criminal offenses.

Some of the initiatives proposed at the meeting were related to strengthening capacities of prosecutorial, tax and other authorities for investigating and detecting illegally acquired property, enabling prosecutors to directly access databases of relevant institutions and agencies which store information on property, and improving prosecutorial skills in writing indictments in order to avoid the negative outcomes of procedures which may be due to such mistakes.

The meeting was also attended by investigators from the Department of Economic Crime and Corruption of the Ministry of Internal Affairs of the Tuzla Canton, together with the head of this department Jasmina Duvnjaković. Therefore, this was an opportunity to discuss improvement of cooperation between the police and the prosecutor's offices, especially following a good example of weekly meetings between KT TK and MUP TK.

The organization of the meeting was initiated and supported by USAID's Justice Project in BiH in partnership with the project "Strengthening Public Integrity in the Federation of Bosnia and Herzegovina and the Republic of Srpska" funded by the Government of the United Kingdom.

USAID's Justice Project in BiH is a continuation of capacity building activities and is part of the broader action of the United States Government to promote democracy and the rule of law in BiH. The working meeting was organized as part of the implementation of the PO Partnership Program with Tuzla PO which has been implemented since 2015.

The project "Strengthening public integrity in the Federation of BiH and the Republika Srpska" is a Project that directly supports the governmental institutions of the Federation of Bosnia and Herzegovina and the Republika Srpska in anticorruption activities and implementation of strategic anti-corruption priorities. A special focus of this project is also the long-standing support of the Government of Great Britain in the establishment and implementation of the system for seizure of property acquired through a criminal offense.
