Disciplinary responsibility of judges and prosecutors in BiH

"The publication of decisions with full reasoning in disciplinary cases against judges and prosecutors contributes to the establishment of a better body of jurisprudence. Also, in this way, public confidence in the transparency of the disciplinary procedure is strengthened," said Victoria Henley, disciplinary prosecutor from California, USA, today (April 25, 2018) in Sarajevo at a seminar for representatives of the justice community in Bosnia and Herzegovina (BiH).

She explained that it is crucial to explain in detail the reasons for making a certain decision in a disciplinary case against a judge or prosecutor, and that this is an essential component of a fair trial.

"Judges and prosecutors are expected to respect ethical codes that promote high standards of professional behavior. Transparency of disciplinary decisions and strengthening of citizens' confidence are crucial in the process of integration into the European Union. That's why it's important to talk about these topics, " Deputy Chief Disciplinary Prosecutor Mirza Hadziomerovic said.

This seminar was organized by USAID's Justice Project in BiH, Centers for Education of Judges and Prosecutors of the Federation of BiH and Republika Srpska. Around 40 representatives of the BiH justice community participated in the seminar, including the majority of the members of the High Judicial and Prosecutorial Council (HJPC) of BiH, representatives of the Office of the Disciplinary Counsel and representatives of the Secretariat of the HJPC of BiH.
